Security deposits

Your deposit is your money.

A landlord can keep part of a deposit for real damage or unpaid rent. They can't keep it for ordinary wear, or just because you moved out. We help you ask for it back, in writing and in court.

The best deposit case starts before you move out: dated photos of every room, your lease and proof of what you paid. If you've already moved, we work with what you have.

What we help with

  • Deposits held back after you move out

  • Deductions with no receipts

  • Landlords who won't send an itemized list

  • Deposits nobody will give a straight answer about

From move-out to your deposit

  1. 01

    Step 1: Before you leave

Take dated photos of every room and keep your move-in paperwork.

  2. 02

Step 2: When you move out

Give your new address in writing so the deposit knows where to go.

  3. 03

Step 3: If the money doesn't come

Send a demand letter. We have a sample, and we'll review yours before you send it.

  4. 04

Step 4: If they still won't pay

Small claims court is built for exactly this. We prepare you for it and, if you qualify, go with you.

Questions about deposits

How long does a landlord have to return it?

State law sets the deadline, and it differs. Tell us your move-out date and we'll give you the number.

Can they keep it for cleaning or paint?

A landlord may charge for cleaning a place left truly dirty. Normal wear, like faded paint, is not a deduction. Ask for the itemized list.

I never got a receipt for the deposit.

Keep your lease and any bank record that shows you paid. Those are your proof.

Can I use my deposit as last month's rent?

Not unless your landlord agrees in writing. Doing it anyway can bring a notice for unpaid rent.

Waiting on your deposit?

Send us your lease, your move-out date and what your landlord said. We'll tell you what to do next.

Free for tenants who qualify. We tell you about any court fee before we file anything.
